MAK DRIVING ACADEMY LIMITED TERMS AND CONDITIONS

1. Refund and Cancellation Policy

For all courses:

Full refund upon cancellation of course on a clear 7 days’ notice.
Half refund upon cancellation of course on a clear 3-6 days’ notice.
No refund for cancellation within 48 hours, fees will be forwarded to any Re-Scheduled booking.
Refund is NOT applicable for cancellations made within 24 hours of booking unless evidence of extraordinary circumstances such as death certificate, medical certificate or any other document approved by course admin.
Administration cost of $100.00 + Gst would be retained for all of the above.

2. Group Booking Discounts

If you are registered for a group discount, the discount will only be applicable if the whole group has been attended as per commitment. If the required number of people for the group discount cannot be met, each employee will be charged the usual list price (if they fail to inform the admin).

3. Company In-House Training

All in-house training is conducted under the guide lines of NZTA – SOAC with the following requirements. The course venue shall be conducive, hygienic, be of sufficient size to accommodate the number of people, silence shall be maintained all times, adequate lighting, heating, ventilation, table, chairs and toilet facilities shall be provided by the company in charge of hosting the training. (Note: – The company indemnifies the trainer from any incident / accident / mis-hap that happens during the training at their premises).

4. Health and Safety Act 2015

The Company will ensure and maintain all health and safety measure in accordance with Health and safety at work Act 2015, and also will avoid to themselves or to any other persons. Failure to adhere to any requirements instructed by the trainer or any staff member will result in disqualification from the training forthwith.

5. Special Needs Or Extra Requirements

Any person attending any course run by MAK DRIVING ACADEMY Ltd. Shall declare their special needs 24 hours prior to the training session in writing at the time of enrolment.
Please note that there will be additional charges if the candidate has language barrier problem ($300 + GST Per Unit Standard) – If a student doesn’t meet the level of written and oral English equivalent of IELTS 5.5 or higher, any extra driver training ($240 + GST per hour) if required, Re-assessment charges (240 + GST), extra time spend on theory ($70 + GST Per Hour).
Kindly note that additional charges may apply for courses held on weekends. For further details, please check with our admin team.
You must meet the level of written and oral English equivalent to IELTS 5.5 or higher as part of the assessment.
Candidate is responsible to check any extra charges, the company or trainer is not liable for it.
Invoice for Language Barrier/extra driver training/extra time spend on theory / Re-assessment payments Must be made before certificate handed over.
Course fees is non-refundable.
Provision of certificate only be granted, once the candidate meets the standard requirements.
If you’re trying to convert your overseas license in New Zealand and the NZ Transport Agency (NZTA) refuses to provide the required certificate because of safety concerns with the candidate, the company or any provider/contractors won’t be responsible for NZTA Assessment/Exemption for the grant of NZ Licence (No refund policy apply).

6. Disclaimer of Liability

Customer Indeminify Mak Driving Academy Ltd, Manik Arora and trainers working under Mak Driving Academy Ltd, Local Bodies and Landowners, their agents, contractors, and all officials aginst any claims arising from my attendance at this event.
Client is aware the training might: (a) Cause me or anyone else injury/harm, (b) Damage to my or third-party property.
Client wish to take part in this event despite the above risks.
Neither Client, nor anyone associated or connected with me, will make any claim against Mak driving Academy Ltd or their officers/employees or agents in respect of, any injury to me or damage to any property regardless of how the damage or injury occurs.
Client will take full responsibility for all claims, damages or losses (including costs), which occur as the direct or indirect result of any injury to myself, owner/instructor or damage to third-party property.
Client should be physically fit and there is no health or other reason why I should not participate in this event.
Client aware that this disclaimer will not affect any legal obligations you have to the company, which you cannot contract out of under New Zealand law.
Client agree that in this disclaimer “My Property” includes any property owned by company or in my possession, or under my control and “third party property” which is affected by my actions.
Client agree that this disclaimer will be binding on my family, their Heirs, my legal assigns and my administrators and executors.
Client using any vehicle, machinery or equipment supplied by MAK Driving Academy Ltd, will hold fulll responsiblity for any damage caused to the vehicle, machinery or equipment while it is in their (Client) control. I agree to pay for any costs – parts, labor or repair to the vehicle, machinery or equipment. I am also liable to pay any damage/cost occurred to third party due to my actions while undertaking this driver training and driver assessment.
During car training, if you are involved in an accident, hit another vehicle or person, or cause any damage, you will be personally liable for any fines or repair costs incurred. The company will not be responsible for any such expenses.
Please drive responsibly and adhere strictly to all traffic rules and safety guidelines.

7. Terms & Conditions Modifications

We retain the right to alter these Terms and Conditions at any time, and if we do, we will update on the website.
We do not offer refunds for any services or products provided (if you didn’t finished your course with in the timeframes as per requirments you need to re-set again and pay new course fee).
